1. Agreement
By using Marshmellos ("Service"), you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. We provide email infrastructure: API, dashboard, templates, and delivery visibility. We do not guarantee specific delivery outcomes (e.g. inbox placement); we give you the tools and real data to operate and improve.
Marshmellos is operated from Italy. Product development is in Tel Aviv.
2. Acceptable use
You will not use the Service for illegal purposes, spam, phishing, or to send to recipients who have not consented where required by law. You will not abuse the API or attempt to circumvent rate limits or security. You are responsible for your content and for complying with applicable law (e.g. CAN-SPAM, GDPR, local anti-spam and data protection rules). We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk.
3. Account and data
You keep ownership of your data. You grant us the rights needed to operate the Service (e.g. to send emails, store templates, and show you events and statistics). Our Privacy Policy describes how we handle personal data. We may use aggregated, anonymized data to improve the product.
4. Service level
We strive for reliability and transparency. We do not guarantee uninterrupted availability. We will communicate materially about outages or changes. Billing terms, when we launch paid plans, will be set out in a separate agreement or plan page.
5. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or revenue. Our total liability is limited to the amount you paid us in the twelve months before the claim (or zero if you have not paid). Some jurisdictions do not allow these limitations; in such cases our liability is limited to the fullest extent permitted.
6. Changes
We may update these Terms. We will post the updated version and, for material changes, we will give notice (e.g. by email or in-product). Continued use after the effective date constitutes acceptance. If you do not agree, you may close your account.
